These terms of service (the “Terms”) are an agreement between Epic House SIA, registration number 40203716958, with registered office at Duntes iela 6, Riga, LV-1013, Latvia (the “Provider”, “we”), and the person who creates an account, takes out a subscription or buys a report on Clavy (“you”).
By creating an account, signing in or otherwise using Clavy, you accept these Terms. If you accept them on behalf of a company or agency, you confirm that you may bind it.
1. The service
Clavy offers public property, town and neighbourhood pages for the Costa del Sol, an account area with features for subscribers, and property reports as PDF (the “Service”).
2. Plans, prices and payment
You can buy a single report or take out a monthly or annual subscription. Each subscription includes a number of reports a month; reports not used in a month can be used in the following month and then expire. Extra report packs, available to subscribers, and single reports do not expire.
The plans, their prices before VAT and the reports each includes are shown on the pricing page. VAT at the rate of your country is added at checkout and shown before you confirm payment; a business with a valid EU VAT number pays without VAT where the reverse charge applies.
Payment is processed by Stripe. Clavy does not receive or store card details. A subscription renews automatically at the end of each period with the card on file until you cancel it.
You can change plan or billing period, prorated, and cancel the subscription from the billing portal. Cancellation takes effect at the end of the paid period; reports already granted stay available until they expire. Cancelling a subscription is not the same as withdrawing from the contract (section 9).
We may change prices with at least 30 days' notice by e-mail. A new price applies from your next renewal, and you can cancel before it does.
If a payment fails, we may suspend the subscription's features until it is paid.
3. Reports
A report is supplied as a PDF file and in your account area as soon as it is ready.
The PDF can be read with any standard PDF reader; the interactive pages of the Service need a current web browser.
A report describes the property as its sources showed it when the report was prepared; it is not updated afterwards.
4. Your account
You must be at least 18 years old to create an account or buy a report.
You sign in with your e-mail address and a password. Use an e-mail address of your own, keep it under your control and do not share your password. You are responsible for what is done with your account.
Every account has a personal workspace. Reports ordered in a shared workspace are visible to its members.
You can download your data from the account page. To delete your account, write to privacy@clavy.io from the e-mail address on your account; deleting it from the account page is not yet available. Section 14 and the Privacy policy explain what is erased and what is kept.
5. Consumers and professionals
If you act for purposes outside your trade or profession you are a consumer and keep every right the law of your country of residence gives you; nothing in these Terms limits those rights. Provisions marked as applying to professionals apply only to customers who use Clavy for their trade, business or profession, such as estate agents, advisers and other businesses.
6. Nature of the estimate
Clavy provides an automated market-value estimate for information purposes. It is always shown as a range, never as a single figure.
It is not a regulated appraisal under Royal Decree 775/1997 or Order ECO/805/2003, it is not issued by an approved appraisal company, and it may not be used for mortgage, insurance, judicial, fiscal or any other purpose that requires a regulated appraisal. It carries no certificative value.
Clavy does not verify and does not warrant occupancy, tenancy, the legal shape of title, protected-housing status or the planning legality of any property. Verify them with a lawyer, a notary and the Registro de la Propiedad before any transaction.
The sources behind the facts and their licences are listed on the legal information page.
7. Using and sharing reports
You may view, download and print your reports and share them with specific people for the transaction they concern. You may not resell them, publish them in bulk or extract their data to build another product.
A person who receives a shared report acquires no rights against the Provider beyond those the law gives them.
When you share a report, keep its source credits intact. These limits apply to Clavy's reports and pages; they do not restrict any right you have to obtain public data from its original source and reuse it under that source's own licence.
8. Acceptable use
You agree not to:
copy or extract the Service's data in bulk, or use it to build another product or database;
get around rate limits, access controls or the limits of your plan, or use another person's account;
upload malware or interfere with the Service or its security;
use the Service against the law, including EU sanctions.
We may suspend an account that breaches this section after telling you, or at once if the breach is serious or continuing.
9. Right of withdrawal
If you are a consumer, you may withdraw from a contract made with us online within 14 days without giving any reason, except as this section explains.
Before you pay, the order confirmation page summarises what you buy, the price and the term, and asks you to accept these Terms and to request that the service start immediately, acknowledging that you lose the right of withdrawal once supply of each report begins. Clavy records with your order the version and the exact publication of these Terms that were shown to you, together with a digest (hash) of their text. If these Terms change between the page being shown and your payment, you are asked to read and accept the new text before paying. The confirmation e-mail names the version you accepted and links its exact text, which stays readable on this page under that version.
Single reports and report packs are digital content supplied at your request: the right of withdrawal ends for each report once its supply begins. Within 14 days of buying a pack you can still withdraw for the reports you have not yet ordered.
Subscriptions can be withdrawn from within 14 days of taking them out. Because you asked for the subscription to start immediately, we refund what you paid less an amount proportionate to what was provided until you told us; the right ends for each report once its supply begins. Cancelling a subscription from the billing portal stops its renewal; it is not a withdrawal.
To withdraw, tell us clearly before the 14 days end. You can do it online from your billing page: while a purchase is within its 14-day period, the button “Withdraw from contract” next to it opens a confirmation step; once you confirm, Clavy records the time of your request and sends you an acknowledgement by e-mail. You may also write to hello@clavy.io from the address on your account, using the model form at the end of these Terms if you wish. We refund within 14 days of your request, to the means of payment you used.
10. Liability
We provide the Service with reasonable skill and care. Estimates and other information are given for information purposes and may be inaccurate; check them before relying on them (section 6).
If you are a consumer, we are liable as the law of your country of residence provides.
If you are a professional, to the extent the law allows, neither party is liable for indirect or consequential loss, or for lost profits, revenue or goodwill, and our total liability for all claims in any 12-month period is limited to the fees you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, gross negligence or wilful misconduct, for death or personal injury caused by negligence, or any other liability that the law does not allow to be limited.
11. Intellectual property
The Service, its software, design, texts and reports belong to the Provider or are used under licence. Nothing in these Terms transfers them to you. Information from public sources stays subject to its own licence, listed on the legal information page.
12. Third-party services and data
The Service relies on the providers described on the Sub-processors page and on public data sources. We are not responsible for their availability or for changes they make.
Property facts are Clavy's own elaboration from public records, chiefly those of the Dirección General del Catastro, which neither participates in nor sponsors or endorses Clavy and is not responsible for its products. Information derived from those records may be out of date or incomplete and carries no legal certainty (fehaciencia) as to the physical, legal or economic circumstances of a property. Each report lists its sources and their licences.
Market information comes from sale listings delivered by Scout, a service operated by the same company, Epic House SIA, as observed by Clavy since tracking began; it shows asking prices, never sale prices, and a listing leaving the market is not a sale.
13. Availability and changes to the Service
We aim to keep Clavy available at all times, apart from maintenance and events beyond our control, but we do not promise a particular level of availability. We may change features; if a change removes a material part of a paid plan, you may cancel and we refund the unused part of the prepaid period.
14. Suspension and closing your account
We may suspend an account used unlawfully or against these Terms. You may cancel your subscription at any time and ask us to delete your account by writing to privacy@clavy.io from the e-mail address on your account (section 4).
When your account is deleted, your account data and your reports are erased, with the exceptions the Privacy policy explains: reports ordered in a shared workspace stay with that workspace, without your name; orders and the other accounting records we must keep by law are kept without your account identifier.
15. Changes to these Terms
Each version of these Terms carries a version number and an effective date, both shown at the top of this page, and earlier versions stay readable below it. A new version may be published before its effective date; it is then announced on this page while the current version stays in force. We will tell account holders of a material change by e-mail at least 30 days before it takes effect, and you may cancel before then. A purchase remains governed by the version you accepted when you made it.
16. Force majeure
Neither party is liable for a failure to perform caused by events beyond its reasonable control, such as natural disasters, war, strikes, network or power outages or government action, provided it tells the other party promptly and resumes as soon as it reasonably can.
17. Governing law, complaints and disputes
These Terms are governed by the law of Latvia. If you are a consumer, you keep the protection of the mandatory rules of your country of residence, and you may bring proceedings in the courts of your country of residence or of Latvia. For professionals, the courts of Riga have exclusive jurisdiction.
If you have a complaint, write to hello@clavy.io and we will try to resolve it with you first. If you are a consumer, you may also turn to the alternative dispute resolution bodies and the consumer authorities of your country of residence: in Latvia, the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs, PTAC); in Spain, the consumer arbitration system (Sistema Arbitral de Consumo) and the consumer authorities of your autonomous community. We will name the alternative dispute resolution body we take part in once that is confirmed. The European Commission's online dispute resolution platform closed in July 2025 and is no longer available.
18. General
Entire agreement. These Terms, in the version you accepted, the Privacy policy and the confirmation of each purchase form the whole agreement between us.
Assignment. You may not transfer your rights under these Terms without our consent. We may transfer them as part of a corporate transaction, keeping your rights intact.
Notices. To us: hello@clavy.io. To you: the e-mail address on your account.
Severability. If a provision is held unenforceable, the rest stays in effect.
Language. These Terms are published in English and Spanish with the same content; both versions are available on this page.
